Welcome to Go Near God. These Terms of Service (“Terms”) govern your use of the Go Near God mobile application and related services (“Service”) offered by Phase One, LLC (“we,” “us,” or “our”). The Service is a faith-based app that provides personalized devotionals, spiritual moments, community groups, and related features. By downloading, installing, or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.


1. Eligibility and Acceptance

  • You must be at least 13 years of age (or the age of consent in your jurisdiction, if higher) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement.
  • If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
  • We may update these Terms from time to time. We will notify you of material changes by posting updated Terms in the app and/or updating the “Last updated” date. Continued use after the effective date of changes constitutes acceptance. For significant changes, we may provide additional notice (e.g., in-app or email).

2. Description of the Service

Go Near God provides:

  • Spiritual moments: Guided experiences (e.g., morning gratitude, personalized devotionals, conversational prayer, evening surrender) that may include AI-generated content based on your inputs and preferences.
  • Personalization: A private “living summary,” stored interactions (including multi-turn Afternoon Tea conversations), and other data (see our Privacy Policy) used to tailor devotionals and responses.
  • Community: Optional private groups where you can share content and interact with other members in accordance with these Terms and in-app rules.
  • Subscription (Go Near God Premium / Go Near God Pro): Certain features may require a paid subscription. Trial and payment terms are described in Section 6 and are subject to the applicable app store (Apple App Store or Google Play) rules.

We strive to provide a helpful, respectful experience but do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features with reasonable notice where practicable.


3. Account Registration and Security

  • You must create an account (e.g., via email/password, Google Sign-In, or Sign in with Apple) to use the Service. You agree to provide accurate information and to keep your account credentials secure.
  • You are responsible for all activity under your account. Please notify us promptly if you suspect unauthorized use.
  • We may suspend or terminate your account if you breach these Terms or for other legitimate reasons (e.g., safety, abuse, or legal compliance).
  • Communications consent: By creating an account, you consent to receive transactional and service-related communications from us (e.g., password resets, account notices, security alerts). These are necessary to operate your account and are not marketing messages. You may manage optional push notifications in the app settings.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable law or the rights of others.
  • Harass, abuse, defame, or threaten others, or post content that is discriminatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Attempt to gain unauthorized access to the Service, other accounts, or our or our providers’ systems.
  • Use the Service to distribute malware, spam, or unsolicited communications.
  • Scrape, reverse-engineer, or automate access to the Service in a way that burdens our systems or violates our policies.
  • Use the Service for any commercial purpose (e.g., reselling, advertising) unless we have agreed in writing.
  • Attempt to manipulate, bypass, circumvent, or exploit the app’s AI systems, theological guardrails, crisis detection protocols, or content filters — including through prompt injection, jailbreaking techniques, disguised instructions embedded in prayer or devotional inputs, role-play scenarios, or any other method intended to cause the AI to produce responses outside its intended spiritual scope. Such attempts are a serious violation of these Terms and may result in immediate account termination.
  • Use, reproduce, distribute, publish, sell, or create derivative works from AI-generated content produced by the Service for any commercial purpose or public redistribution. AI-generated devotionals, prayers, and responses are licensed to you for personal spiritual use only.
  • Probe, scan, test the vulnerability of, or attempt to gain unauthorized access to our Firebase infrastructure, Cloud Functions, API endpoints, prompt architecture, guardrail configuration, or any other backend system. This includes attempting to extract, reconstruct, or reverse-engineer the proprietary prompt and theological configuration systems that power the Service.
  • Intentionally overload, disrupt, sabotage, or interfere with the Service or its underlying infrastructure in any way.
  • Post content in community groups that promotes or normalizes self-harm, abuse, exploitation, or that is intended to spiritually manipulate or coerce other members.

We may remove content that violates these Terms or our policies and may suspend or terminate accounts for repeated or serious violations. With respect to community groups, we reserve the right to moderate, remove, or hide any group content without prior notice when we believe it violates these Terms, harms the community, or for other operational or safety reasons. We may also cooperate with law enforcement and take other steps we deem necessary to protect the Service and users.


5. User Content and License

  • Your content: You retain ownership of content you create or upload (e.g., text, posts in groups). You are responsible for that content and represent that you have the right to share it.
  • License to us: By submitting content through the Service, you grant us a non-exclusive, royalty-free, worldwide license to use, store, process, display, and transmit that content as necessary to provide and operate the Service. This includes sublicensing to our service providers (e.g., cloud hosting, AI providers) to the extent needed to run the Service. We do not use your content for marketing or unrelated purposes except as described in our Privacy Policy or with your consent.
  • AI-generated content ownership: AI-generated content produced by the Service (including devotionals, prayers, reflections, and companion responses) is owned by or licensed to Phase One, LLC. We grant you a limited, personal, non-transferable, non-sublicensable license to use that content for your own private spiritual purposes only. You may not reproduce, distribute, publish, sell, or create derivative works from AI-generated content without our prior written consent.
  • Community group content: Content you post in groups is visible to other group members. We are not responsible for content posted by other users. By participating in groups, you agree to our community standards. We reserve the right but not the obligation to monitor, edit, or remove group content.
  • Feedback: If you submit ideas, suggestions, or feedback about the Service to us, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use, incorporate, and build upon that feedback without any obligation or compensation to you.
  • Deletion: You may delete your account using Settings → Delete Account. See our Privacy Policy for what is removed. Reset Memory in Settings clears certain stored content but is not the same as deleting your account. You may also contact our support team for help with account or data requests.

6. Subscription, Payments, and Refunds

  • Subscriptions: Some features may require a paid subscription (Go Near God Premium or Go Near God Pro). A subscription may include a free trial. Pricing and trial length are displayed in the app and may be updated.
  • Billing: Subscriptions are processed through the Apple App Store (iOS) or Google Play (Android). Payment will be charged to your store account at confirmation of purchase. Subscriptions typically auto-renew unless you turn off auto-renewal at least 24 hours before the end of the current period.
  • Cancellation: You may cancel a subscription at any time through your device’s store settings. Cancellation takes effect at the end of the current billing period; no refund is provided for the unused portion unless required by the store or applicable law.
  • Refunds: Refund requests are handled exclusively by Apple (iOS) or Google (Android). Phase One, LLC does not process or provide refunds directly. All refund requests must be directed to Apple or Google support.
  • Price changes: We may change subscription prices with advance notice. Price changes apply at your next renewal. Continued use after the change constitutes acceptance.
  • Free trial: If you start a free trial, you may be charged when the trial ends unless you cancel before the trial period ends, per the store’s trial terms.

7. Intellectual Property

  • Our property: The Service (including design, text, graphics, logos, software, prompt architecture, guardrail systems, and theological configuration, but excluding your content) is owned by or licensed to Phase One, LLC and is protected by copyright, trade secret, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content or the Service except as necessary to use the app in the normal intended way.
  • Trademarks: “Go Near God,” the Go Near God logo, and related marks are trademarks of Phase One, LLC. You may not use them without our prior written permission. All other trademarks referenced in the Service (Apple, Google, Firebase, OpenAI, etc.) belong to their respective owners.
  • Proprietary systems: The app’s AI prompt architecture, guardrail system, theological configuration, living summary system, and related proprietary systems constitute trade secrets and confidential information of Phase One, LLC. You agree not to attempt to extract, reconstruct, publish, or exploit these systems by any means, including through manipulation of AI outputs, reverse engineering, or systematic probing.

  • Scripture and AI-generated content: Go Near God uses AI to generate devotional content that may reference, paraphrase, or quote Scripture. We do not hold licenses to any specific Bible translation. AI-generated content may paraphrase biblical themes rather than quote any translation verbatim. We make no warranty that AI-generated Scripture references are accurate, complete, or match any specific translation. The underlying Scripture text belongs to its respective copyright holders (for modern translations) or is in the public domain (for translations such as the KJV). For authoritative Scripture, always consult a trusted Bible app or your church.
  • DMCA / Copyright infringement: We respect intellectual property rights. If you believe content in the Service infringes your copyright, contact our designated agent with: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material; (3) your contact information; (4) a statement of good faith belief that the use is not authorized; and (5) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

8. Disclaimers

  • Not professional advice: The Service is for spiritual encouragement and personal reflection only. It is not a substitute for professional medical, mental health, legal, financial, or pastoral advice. Always seek qualified professionals for such matters.
  • Crisis and safety: The app may provide referrals to crisis resources (e.g., 988, crisis hotlines) when certain content is detected. We are not a crisis or emergency service. If you or someone else is in danger, contact emergency services immediately. Crisis detection is automated and may not identify every situation requiring professional help.
  • Mental and emotional health: Use of the Service does not constitute a therapeutic relationship of any kind. We are not mental health professionals. AI-generated spiritual encouragement is not a substitute for counseling, therapy, or psychiatric care. Phase One, LLC expressly disclaims any liability for mental, emotional, spiritual, or psychological outcomes arising from use of the Service.
  • AI-generated content: Devotionals and other AI-generated content are created by third-party AI systems (OpenAI). We do not guarantee the accuracy, completeness, theological correctness, or suitability of that content for your situation. AI systems can produce errors, inconsistencies, or unexpected outputs. Use your own judgment and consult trusted sources where appropriate.
  • Theological disclaimer: AI-generated spiritual content reflects general biblical themes and is intended for encouragement and personal reflection only. It should not be treated as authoritative theological teaching or a substitute for pastoral counsel, denominational teaching, or your own study of Scripture. For matters of doctrine or faith practice, rely on your church and qualified spiritual advisors. Phase One, LLC makes no representations regarding the theological accuracy or denominational alignment of AI-generated content.
  • Service “as is”: To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied (including implied warranties of merchantability, fitness for a particular purpose, and non-infringement). We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

9. Limitation of Liability

  • To the maximum extent permitted by applicable law, Phase One, LLC and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, goodwill, or spiritual outcomes) arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
  • Our total liability for any claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
  • Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Phase One, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your content or conduct, (c) your violation of these Terms or any law, (d) your violation of any third-party rights, or (e) your attempts to circumvent, manipulate, or exploit the Service’s AI systems or guardrails. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.


11. Dispute Resolution and Governing Law

  • Governing law: These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
  • Informal resolution: Before filing a formal dispute, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.
  • Individual disputes only — Class Action Waiver: To the fullest extent permitted by law, you agree to resolve any dispute with us on an individual basis only, and not as part of any class, collective, consolidated, or representative action or proceeding. You waive any right to bring or participate in a class action lawsuit against Phase One, LLC. If this waiver is found unenforceable, the entirety of this dispute resolution section shall be null and void.
  • Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction for claims related to intellectual property, unauthorized access, or misuse of the Service’s AI systems. You may also bring qualifying claims in small-claims court.

12. Apple and Google Store Terms

  • Third-party beneficiaries: If you access the Service through the Apple App Store or Google Play, Apple (for iOS) and Google (for Android) are third-party beneficiaries of these Terms and have the right to enforce them against you.
  • Store rules: Your use of the app is also subject to the applicable store’s terms and conditions. Where those terms conflict with these Terms regarding the store’s relationship with you, the store’s terms govern.
  • Account deletion: You may delete your account in the app via Settings → Delete Account (under ACCOUNT). The flow may require re-authentication. You may also contact us for assistance. Subscription billing is managed separately through your store account; cancel there if you wish to stop charges.

13. Force Majeure

Phase One, LLC shall not be liable for any failure or delay in performance of the Service arising from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic or public health emergencies, war, terrorism, government action, internet or telecommunications failures, third-party service outages (including Firebase, OpenAI, Apple, Google, or RevenueCat), cyberattacks, power failures, or any other event outside our direct control. Our obligations under these Terms will be suspended for the duration of such events.


14. Right to Modify or Discontinue the Service

We reserve the right, at our sole discretion and at any time, to modify, suspend, or permanently discontinue the Service or any part of it, with or without notice. We may also terminate or suspend your account for any reason, including breach of these Terms, at our sole discretion. Phase One, LLC shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. If the Service is discontinued, we will make reasonable efforts to provide advance notice where practicable.


15. General

  • Entire agreement: These Terms, together with our Privacy Policy and any in-app policies we notify you of, constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.
  • No third-party beneficiaries: Except as stated in Section 12, these Terms do not create any third-party beneficiary rights.
  • Headings: Section headings are for convenience only and have no legal effect.
